With this in mind, we’re sharing the latest Homeowners Forum Q&A, which addresses common questions and concerns raised by residents. Native Landscaping
Vista at Montaine benefits from open spaces both within and surrounding the community, featuring landscaping native to Colorado. One of the advantages of native grasses is their low water usage, which saves the community a significant amount compared to the water-intensive irrigation required for non-native sod. Toll Brothers is committed to establishing native landscaping in accordance with the standards set by the Town of Castle Rock and its own high standards. While native landscaping is beautiful once fully established, the process can take between 3 to 8 years. Until then, Toll Brothers will continue re-seeding efforts and implement appropriate erosion control measures. Weed mitigation is managed by landscaping partners to ensure the longevity of native seeding. While spraying helps, the natural process of allowing native grasses to choke out weeds also plays a key role, ensuring stronger native seeds can continuously re-seed. Native grasses are mowed twice a year—in spring and fall. Beauty banding is maintained in some areas of Montaine, along trails and concrete, with exceptions depending on the width of tree lawns in common areas. Landscaping Audit

The association has engaged Brightview to provide landscaping services to the community. The board and Toll Brothers are aware of concerns regarding the landscaping at the park at Simmental and Railheads. The grass is not dead but is receiving significant attention. An issue with the irrigation system has been identified, and a resolution is underway. Brightview is also conducting audits to address both dead trees and potential irrigation issues.

The Design Guidelines address the color of the residential fences, not the amenity fence. However, the Site Development Plan specified the color of the fence for the clubhouse.

 

While the Montaine community is bordered by natural landscaping from the surrounding areas, this means living in harmony with local wildlife. At times, this may result in wildlife feces being found on or near the walking trails. Additionally, while the association encourages homeowners to pick up after their dogs, it cannot guarantee full compliance.

Pool Repairs
The Vista pool opened for the 2024 season with the expectation that only cosmetic repairs would be addressed during the off-season later this year. While Toll Brothers anticipates additional work around the Vista amenities, the priority was to provide access to the community pool as soon as possible. Unfortunately, concerns arose regarding the discoloration of the spa and heating elements for both the pool and spa. Missing tiles and other cosmetic items will be addressed after the pool and spa close for the season to minimize disruption to homeowners. As with any community, some repairs may need to be handled earlier than expected, which could require temporary closures. The pool and spa season will not be extended this year, as the board is aware of work scheduled during the off-season.

 

Pool Monitors
The monitors at the pool are in place to address any issues that may arise and serve as “boots on the ground” for the pool’s maintenance. They ensure the cleanliness of the pool, spa area, and restrooms throughout all hours of operation. Occasionally, they also hand out popsicles to homeowners and children. The board understands concerns regarding the use of monitors instead of lifeguards and is currently considering this matter.

Toll Brothers, in partnership with the association, is actively addressing erosion control around the courts, including re-grading, re-seeding, and cleaning the courts. Silt fences and a new cobble swale have been installed to ensure proper drainage. Cohere is currently working to secure maintenance proposals for the courts, which will include both regular and as-needed cleaning schedules. Additionally, pickleball divider nets have been installed.

This is being performed on an as-needed basis through areas of recent construction.

Disputes between homeowners should be addressed directly between the parties involved, as appropriate. The association does not intervene in homeowner-to-homeowner conflicts.

The recent amendment to CCIOA, House Bill 22-1137, introduces a significant change by prohibiting associations from enforcing covenants on public rights-of-way. This means that restrictions on parking for boats, RVs, and similar vehicles on public streets may no longer be enforced by associations.

Vista and Regency are separate but share the Cohere staff and costs associated with the same. As such, a staffing agreement is needed to address this.

The Cohere-managed Facebook page was not intended as a portal for homeowners to contact the board or Cohere staff, but rather as a way to share information with the community. Despite best efforts, some confusion has arisen regarding its use. As a result, the Facebook page has been discontinued. There are no other official community Facebook pages, and any activity in private Facebook groups is not under the purview of Cohere or the board.

The common tracts and amenities for the Vista at Montaine community are turned over at the time of initial completion. However, Toll Brothers continues to work with the Association to ensure that all items are addressed for repair/remedy as needed during the warranty period. Toll Brothers is dedicated to ensuring the final product is one to make the community proud.

 

Currently, there are no plans to hire Ambassadors for the Vista Amenity Center, as this has not been budgeted for 2024. The matter will be discussed in future budget meetings as the community grows and needs evolve. The Ambassador role is a part-time position designed to provide a warm and welcoming presence, supporting residents during events, programs, and other engagement activities.

Cohere provides compliance checks regularly to ensure homeowners adhere to the Covenants. While there may be an area of concern, this does not mean it is not already being addressed. Please contact Cohere to notify of locations of specific concern to ensure this is being addressed appropriately. Please refer to covenant enforcement policy found on the website.

Meetings are intended for the Board of Directors to conduct business to attend to items for the community's benefit. We receive requests for varying times and locations to be in the community or via Teams, with many homeowners looking to address their respective convenience. Board meetings are held via Teams currently for the convenience of the Board itself and to provide others with an opportunity to join regardless of their location at the time of these meetings.

The Vista amenities are handicap accessible, and no handicap button was required at Vista per building code. To clarify, the Regency and Vista communities are separate entities, but they share the same declarant and are managed by the same company, Cohere.

We are unaware of any lights at the mailboxes, as they were not included in the Development Plan, and Toll Brothers did not install them.

Trash collection is performed weekly in the Montaine community, but Toll Brothers is transitioning to a different contractor. The company contracted for trash removal services one of four quadrants each week, typically at the end of the week. This means not every tract is addressed weekly but on a monthly rotating schedule, which will remain unchanged with the new contractor. Focus is given to areas under heavier construction to manage trash leaving the immediate site. However, wind can impact trash distribution within the community. Toll Brothers and their contractors work diligently to collect debris, though they cannot control every piece. If specific areas are of concern, please contact management to notify Toll Brothers.

At the end of Toll Brother’s warranty period with the Town of Castle Rock, the sidewalk is inspected in bulk as part of the inspection related to the Certificate of Occupancy for each respective lot. These occasionally needed to be re-done to ensure compliance.

The Vista Amenity Center was built per approved plans. The Sales team was provided with the best information available at the time.

The meeting scheduled for March 5 was a Neighborhood Café, not a board meeting. Unfortunately, it was canceled due to the Grand Opening event on March 2. The Board of Directors is actively working with Cohere to secure a new date for this fall.

The Board is aware of the petition that has been circulated. A letter regarding the request for credits/refunds will be circulated with the membership soon.

The association’s reserve funds are being invested and are currently in a Community Association Banking money market account and interest is accruing monthly.

A Blackstone Grill has been purchased and will be installed shortly.
